By downloading, installing, or using SongScribe Tuner ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
SongScribe Tuner is a mobile application that provides real-time instrument tuning using your device's microphone. The App offers:
- Chromatic Tuning: Detects any musical note across a wide frequency range
- Instrument Presets: Optimized tuning modes for Guitar, Ukulele, Bass, and Violin
- Customizable Reference Pitch: Adjustable reference frequency (430-450Hz, default: 440Hz)
- Visual Feedback: Real-time pitch display with needle indicator and cent deviation
- Note Display Options: Choose between sharps or flats notation
3. Free vs. Paid Features
3.1 Free Version (Ad-Supported)
The free version includes:
- All tuning features (chromatic and instrument presets)
- Customizable reference pitch
- Real-time pitch detection
- Banner advertisements on non-tuning screens
Advertising Policy:
- Ads are displayed on settings and informational screens
- NO ads are shown during active tuning to avoid distraction
- Ads are provided by Google AdMob
- You can remove ads permanently with a one-time purchase
3.2 "Remove Ads" Purchase
A one-time, non-consumable purchase of $1.99 (USD) that includes:
- Permanent removal of all advertisements
- Access to all tuning features
- No subscription required
- Purchase is tied to your Apple ID and can be restored on other devices
4. Microphone Permission
The App requires microphone access to function. By granting microphone permission:
- You allow the App to capture audio in real-time for pitch detection
- You understand that audio is NOT recorded, stored, or transmitted
- Audio processing occurs entirely on your device
- You can revoke microphone permission at any time in device settings
If you deny microphone access, the App cannot function as a tuner.
5. Data and Privacy
Your privacy is important to us. Please review our Privacy Policy for details on:
- What data we collect (minimal)
- How we use your data
- Third-party services (AdMob, Apple, Analytics)
- Your rights and choices
Key Privacy Points:
- ✅ Microphone audio is never recorded or stored
- ✅ Settings are stored locally on your device

- ✅ You can delete all data by uninstalling the app
6. Purchases and Payments
6.1 Payment Processing
All purchases are processed through Apple's App Store. By making a purchase, you agree to Apple's terms and conditions.
6.2 Non-Refundable
In-app purchases are non-refundable except as required by law or Apple's refund policy. To request a refund, contact Apple Support.
6.3 Restore Purchases
If you reinstall the App or use it on a new device, you can restore your "Remove Ads" purchase at no additional cost:
- Open the App
- Tap Settings → Restore Purchases
- Sign in with the same Apple ID used for the original purchase
6.4 Price Changes
We reserve the right to change the price of the "Remove Ads" purchase at any time. Price changes do not affect existing purchases.
7. Permitted Use
You agree to use SongScribe Tuner only for lawful purposes. You may NOT:
- Use the App to infringe on intellectual property rights
- Attempt to reverse engineer, decompile, or disassemble the App
- Circumvent any security features or payment systems
- Use the App to transmit harmful code or malware
- Violate any applicable laws or regulations
8. Intellectual Property
8.1 App Ownership
SongScribe Tuner, including its design, features, code, and trademarks, is owned by SongScribe and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.
8.2 User Data
You retain ownership of any settings or preferences you configure within the App. We do not claim ownership of your data.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted or error-free
- Pitch detection will be 100% accurate in all environments
- The App will be compatible with all devices or iOS versions
- The App will meet your specific requirements
Accuracy Notice: Pitch detection accuracy depends on:
- Quality of your device's microphone
- Background noise levels
- Instrument volume and clarity
- Proper tuning technique
We strive for accuracy but cannot guarantee perfect results in all conditions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, or data
- Damage to your device or other property
- Claims arising from your use of the App
Our total liability to you for any claim shall not exceed the amount you paid for the App (maximum $1.99).
11. Indemnification
You agree to indemnify and hold harmless SongScribe and its affiliates from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
12. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will notify users of material changes through:
- In-app notification
- Email (if you provided one for support)
- Update to "Last Updated" date above
13. Termination
We reserve the right to terminate or suspend your access to the App at any time for:
- Violation of these Terms
- Fraudulent activity
- Any other reason at our discretion
Upon termination:
- Your license to use the App ends immediately
- You must cease all use of the App
- You may uninstall the App from your device
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in courts located in the United States.

16. Apple-Specific Terms
If you downloaded the App from the Apple App Store, the following terms apply:
- These Terms are between you and SongScribe, not Apple
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for any product warranties
- Apple is not responsible for addressing any claims related to the App or your use of it
- Apple is a third-party beneficiary of these Terms and may enforce them
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
- You are not listed on any U.S. Government list of prohibited or restricted parties
Apple Standard Licensed Application End User License Agreement (EULA) applies to your use of the App. In the event of conflict between these Terms and Apple's EULA, Apple's EULA prevails.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SongScribe regarding your use of the App and supersede all prior agreements.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19. No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
